DRAMA! Female Police Prosecutor Assault Defendant Lawyer In Court Premises For Losing Case

A police inspector, identified simply as Juliana, on Monday turned the premises of a Magistrate’s Court at Nwaorieubi, Imo State, in the Mbaitoli Magisterial District, into a battle arena after she allegedly attacked the counsel for a defendant, Mr. Samuel Ezume, for alleged uncomplimentary remark against her.

Ezume was in court to defend 54-year-old Charles Agaziem, who was alleged to have used a machete to threaten his neighbor, Longinus Eluchie.

The charge had read, “That you, Charles Agaziem, on August 18, 2016, by 7am, at Ahama Amawuihe Ubomiri, in the Mbaitoli Magisterial District, with intent to intimidate one Longinus Eluchie (m) pointed a machete at his face, thereby committing an offence punishable under Section 86(1) of the Criminal Code, Cap C 38, Law of the Federation of Nigeria, 2004 as applicable in Imo State.”

But Ezume had contended that the charge against the accused was not competent.

He had said, “Your worship, the charge before you is talking of pointing a machete; and a look at Section 86 (2) of the Criminal Code will show that the section is talking of a dwelling house.

“It is trite law that no person shall be tried for an offence not defined in a written law.”

According to Ezume, hardly had the case been struck out when the prosecutor accosted him, held him and beat him up.

He said, “After the case was struck out because of its defects, I left the court room with my client.

“But unknown to me, the prosecutor was following me behind and she quickly rushed at me, held me and began to beat me up and in the process she tore my shirt.

“This attracted the attention of other lawyers around.”

Having noticed what was going on, the magistrate was said to have intervened and demand reasons for the assault.

The policewoman was said to have told the magistrate that the lawyer called her a mad woman.

“But it is a lie because I didn’t even talk to her. Even other lawyers who witnessed the ugly incident dismissed her defence as ridiculous,” Ezume added.

However, the Divisional Police Officer of Mbaitoli division, CSP William Osuji, claimed ignorance of the incident, but promised to investigate the matter.
